Official Rules for Pet Insurance Promotions

OFFICIAL RULES

THESE OFFICIAL RULES (THE "RULES"), AS MAY BE AMENDED BY PETS BEST INSURANCE SERVICES, LLC (THE "SPONSOR"), GOVERN THE "PETS BEST HALLOWEEN COSTUME CONTEST GIVEAWAY" (THE "GIVEAWAY") DESCRIBED BELOW. BY ENTERING THIS GIVEAWAY, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTAND, AND AGREE TO BE BOUND BY THESE RULES. IF YOU DO NOT AGREE WITH EACH PROVISION OF THESE RULES, YOU MAY NOT PARTICIPATE IN THE GIVEAWAY. 

This promotion is managed and sponsored by Pets Best Insurance Services, LLC, located at 11333 N. Scottsdale Rd, #160, Scottsdale, AZ 85254, United States ("Sponsor"). This Contest is in no way sponsored, endorsed, administered by, or associated with Instagram or Meta Platforms, Inc. 

PERIOD AND ELIGIBILITY 

1. The Giveaway begins at 12:00 a.m. Eastern Time ("ET") on October 6, 2026 and ends at 11:59 p.m. ET on October 18, 2026 (the "Giveaway Period"). 

2. The Giveaway is open only to legal residents of the fifty (50) United States and the District of Columbia who have reached the age of majority in their state of residence at the time of entry (each, a "Participant" and collectively, the "Participants"). 

3. Sponsor and its respective officers, directors, employees, agents, representatives, affiliates, subsidiaries, advertising and promotional agencies, and any entity involved in the implementation, administration, judging, or fulfillment of the Giveaway, as well as their immediate family members and persons living in the same household, are not eligible to participate. 

4. Anyone found to use multiple Instagram accounts to enter, submit more than one entry, engage in fraudulent activity, or otherwise attempt to circumvent these Rules will be ineligible and may be disqualified at the sole discretion of the Sponsor. 

5. The Giveaway is void where prohibited by law.  

HOW TO ENTER

6. To be eligible, entries must be submitted during the Giveaway Period.

7. To receive one (1) entry into the Giveaway, a Participant must, during the Giveaway Period:

1. Follow @PetsBest on Instagram;

2. Post an original photo of their pet wearing a Halloween costume to their Instagram account;

3. Tag @PetsBest in the post; and

4. Include the hashtag #PetsBestCostumeContest2026 in the post caption.

8. A Participant may receive a maximum of one (1) Entry during the Giveaway Period, regardless of the number of qualifying posts submitted. 

9. Entries submitted via Instagram must be made from a public Instagram account so that the Sponsor can verify eligibility and locate the Entry. 

10. Entries that are incomplete, submitted outside of the Giveaway Period, violate these Rules, or cannot be reasonably verified by the Sponsor may be disqualified. 

11. By submitting an Entry, the Participant represents and warrants that the submitted content is their original work and complies with all requirements set forth in these Rules. 

12. No purchase is necessary to enter or win. 

13. Alternative Method of Entry. As an alternative to Instagram entry, a Participant may obtain one (1) entry by emailing socialadmin@iphinsure.com (a) an original photo of their pet in a Halloween costume; (b) their full name, email address, and state of residence; and (c) confirmation that they have reached the age of majority in their state of residence. Entries received via this Alternative Method of Entry will be pooled with, and receive the same odds of winning as, Entries submitted via Instagram in accordance with "How to Win" below. A Participant may receive a maximum of one (1) Entry regardless of method used. 

HOW TO WIN 

14. Four (4) potential winners will be selected in a random drawing from among all eligible Entries received during the Giveaway Period. 

15. Sponsor reserves the right to disqualify any Participant or winner and may refuse to award a Prize to any individual who is not eligible, has violated these Rules, has gained an unfair advantage, or has obtained winner status through fraudulent or improper means. 

16. The odds of winning a Prize depend on the total number of eligible Entries received during the Giveaway Period. 

17. Sponsor's decisions regarding eligibility, winner selection, and all matters relating to the administration of the Giveaway are final and binding. 

LIMITATIONS ON WINNING 

18. A Participant cannot win more than one (1) Prize within twelve (12) consecutive months. 

THE PRIZE 

19. Four (4) prizes will be awarded in total. Each prize consists of one (1) $25 USD Virtual Visa® Gift Card, delivered electronically via email.  

20. There will be only one (1) Prize awarded per selected Entry and a Participant may not win more than one (1) Prize in connection with this Giveaway. 

21. The Prize will be delivered electronically to the winner using the email address provided by the winner following verification of eligibility. Any expenses related to prize fulfillment will be covered by the Sponsor. 

22. By accepting a Prize, the winner agrees to allow the Sponsor to use the winner's first name, state of residence, pet's name, and submitted Entry for internal and external marketing purposes, including but not limited to social media, websites, email communications, digital advertising, printed materials, and other promotional channels, without additional payment, compensation, liability, or obligation. Participants understand that they are providing their information to the Sponsor and not to Instagram or Meta Platforms, Inc. 

23. The winner agrees to accept the Prize "as is" and acknowledges that the Prize is non-transferable and may not be redeemed for cash. Sponsor reserves the right to substitute a prize of equal or greater value at its sole discretion. 

24. Neither Sponsor nor any prize fulfillment provider shall be responsible or liable for any warranty, representation, or guarantee relating to the Prize, including any warranties provided exclusively by the issuer of the Virtual Visa® Gift Card. 

ADDITIONAL INFORMATION 

25. Potential winners who entered via Instagram will be notified via direct message from the official @PetsBest Instagram account. Potential winners who entered via the Alternative Method of Entry will be notified by email to the address provided with their Entry. Potential winners may be required to verify their eligibility before claiming a Prize, and, to receive a Prize, a potential winner must provide a valid email address for prize fulfillment and comply with these Rules. 

26. Potential winners will have seventy-two (72) hours from the time of notification to respond and claim their Prize. 

27. If a potential winner cannot be contacted, fails to respond within the required seventy-two (72) hour period, is found to be ineligible, fails to comply with these Rules, or declines the Prize, that potential winner will forfeit the Prize and the Sponsor may select an alternate winner from the remaining eligible Entries. 

28. Sponsor reserves the right to require proof of identity, age, residency, and eligibility before awarding a Prize. 

RIGHTS CLEARANCE 

29. The Participant agrees that the Sponsor may post the Entry on Sponsor owned or controlled websites, viewing galleries, social media platforms, and use the Entry as part of press releases. Further, submitting an Entry constitutes Participant’s waiver of all moral right in and to such Entry in favor of the Sponsor or anyone authorized by the Sponsor to use such Entry. The Participant represents and warrants that: (i) the Entry does not contain any material that is libelous, defamatory, profane or obscene, (ii) the Entry is original and all right, title, and interest (including copyright) therein and thereto is owned and/or controlled by the Participant to the full extent necessary to enable the Sponsor to use the Entry as contemplated by these Rules; and (iii) the Entry does not infringe upon the intellectual property or other statutory or common law rights of any third party.  

30. By submitting the Entry to the Sponsor in connection with the Giveaway, the Participant shall retain all right, title and interest (including copyright) in and to the Entry, and shall grant the Sponsor a worldwide, gratuitous, irrevocable, and exclusive license to copy, use, modify, reproduce, display, adapt and transmit the Entry for use in all media now known or hereafter devised in perpetuity beginning on the date of submission, including, but not limited to, in connection with the administration, promotion and exploitation of the Giveaway. The Participant hereby confirms that the Entry is an original work, solely created by the Participant, and that no third party participated as an author, co-author, photographer or otherwise in the creation of the Entry or any part thereof. The Sponsor assumes no responsibility for any claims of infringement of rights to copyright, privacy and/or personality, and all such liabilities shall remain with the Participant. 

GENERAL TERMS AND CONDITIONS 

31. These Rules shall be governed by and construed in accordance with the laws of the State of Arizona and applicable laws of the United States, without regard to any conflict of law principles. Any dispute arising under or relating to the Giveaway or these Rules shall be subject to the exclusive jurisdiction of the state and federal courts located in Arizona. 

32. The winner may be required to complete and sign a declaration of eligibility, liability release, publicity release, or similar documentation as determined by the Sponsor and permitted by applicable law. 

33. By entering the Giveaway and, if applicable, accepting a Prize, each Participant agrees to the use of their first name, state of residence, pet's name, likeness, submitted content, and Entry for advertising, promotional, publicity, and marketing purposes by the Sponsor without further notice, compensation, or consent, except where prohibited by law. 

34. Information submitted with an Entry is subject to the Pets Best Privacy Policy which may be viewed at https://www.petsbest.com/online-privacy. By entering the Giveaway, Participants acknowledge that they have read and agree to the terms of the Pets Best Privacy Policy and that any personal information provided may be collected, used, and maintained by the Sponsor in accordance with that policy. 

35. Sponsor reserves the right to cancel, suspend, modify, or terminate the Giveaway and amend these Rules at any time if fraud, technical failures, changes in applicable law, or any other factor beyond the Sponsor's reasonable control impairs the integrity, administration, security, or proper operation of the Giveaway. 

36. Sponsor is not responsible for Entries, notifications, communications, or other submissions that are lost, late, misdirected, incomplete, corrupted, illegible, delayed, or otherwise not received by the Sponsor. 

37. Sponsor, Instagram, Meta Platforms, Inc., and their respective affiliates, subsidiaries, advertising and promotional agencies, officers, directors, employees, representatives, and agents shall not be liable for technical malfunctions, computer errors, software failures, internet interruptions, viruses, unauthorized human intervention, or any other error that may affect the administration of the Giveaway or a Participant's ability to enter. Participants found tampering with the entry process or violating these Rules may be disqualified at the sole discretion of the Sponsor. 

38. Instagram and Meta Platforms, Inc. are completely released from all liability related to this Giveaway by each Participant. 

39. A copy of these Official Rules and, where legally required, a winner list may be requested by contacting the Sponsor at the email address below within six (6) months following the end of the Giveaway Period. 

40. This Giveaway is void where prohibited or restricted by law.

BY ENTERING THE GIVEAWAY, THE PARTICIPANT AGREES, ON BEHALF OF HIMSELF/HERSELF, HIS/HER HEIRS, EXECUTORS, REPRESENTATIVES, ASSIGNS, ADMINISTRATORS, AND NEXT OF KIN TO INDEMNIFY, HOLD HARMLESS AND TO RELEASE PETS BEST INSURANCE SERVICES, LLC, ITS EMPLOYEES, OFFICERS, DIRECTORS, AGENTS, PARENT COMPANIES AND AFFILIATES OR SUBSIDIARY COMPANIES FROM ANY AND ALL LIABILITY OR ACTIONS OF ANY KIND WITH RESPECT TO OR IN ANY WAY ARISING FROM THIS GIVEAWAY, PARTICIPATION IN ANY GIVEAWAY-RELATED ACTIVITY; AND/OR DELIVERY/MISDELIVERY, ACCEPTANCE, POSSESSION, USE, OR MISUSE OF THE PRIZE, INCLUDING, BUT NOT LIMITED TO LIABILITY FOR PERSONAL INJURY, BODILY INJURY (INCLUDING WRONGFUL DEATH OR DISABILITY), DAMAGE TO PROPERTY AND DAMAGE OR LOSS OF ANY OTHER KIND.  

When you submit a photo/video with us you agree to the following: 

I, on behalf of myself and my successors, heirs, and anyone else who make a claim for or on my behalf,  hereby agree with and represent to Pets Best and others acting with their permission as follows: 

1. I give permission to Pets Best to use my pet’s image/video that I am submitting, together with my name and my pet’s name, on their website and on any successor website that they may operate from time to time; 

2. I give permission to Pets Best to edit the content and publish edited or partial versions of the content. However, Pets Best will never edit content in such a way as to create a misleading impression of my views; 

3. I waive any right to inspect or approve the photo/video after submission, whether modified or not, that may be used now or in the future; 

4. I agree that I will have no claim to royalties, compensation or other benefit, and no claim (including without limitation, claims based upon invasion of privacy, defamation, or right of publicity) arising out of any use of the photo/video I submit, and 

5. I agree that by submitting an entry, I retain ownership of the submitted photo/video but grant Pets Best a non-exclusive, royalty-free, perpetual, worldwide license to use, reproduce, publish, display, modify, adapt, and distribute the submission in connection with the promotion and Pets Best's marketing, advertising, social media, website, and promotional activities.

NO PURCHASE OR OBLIGATION NECESSARY TO WIN.

1. Eligibility:The 2025 Petfort Music Festival Sweepstakes (the “Sweepstakes”) is open to legal residents of the United States (including DC and the territories of the US), aged 18 or older as of the date of entry (“Eligible Entrants”). The following are not eligible to participate: employees and their families of Independence Pet Holdings (IPH), Pets Best Insurance Services, LLC (“Sponsor”), each of their affiliates, subsidiaries, advertising and promotion agencies and Sweepstakes Exhibitors. By entering, you agree to these Official Rules and the decisions of Sponsor, which are final and binding in all respects. Void where prohibited by law. The Sweepstakes is subject to all applicable federal, state, and local laws and regulations. Sponsor reserves the right, at its sole discretion, to disqualify any entry if it concludes that the entrant has tampered with the entry process or the operation of the Sweepstakes or has acted in violation of the Official Rules or any applicable federal, state, or local laws or regulations.

2. Sweepstakes Period: Sweepstakes begins at 11:00 a.m. Mountain Time (“MT”) through 1:45 p.m. MT on Saturday, 3/29/25, (the “Sweepstakes Period”) at the Treefort Music Festival in Downtown Boise, ID (“Event”).

3. Sponsor: Pets Best Insurance Services, LLC, 11333 N. Scottsdale Rd, #160, Scottsdale, AZ 85254 (“Sponsor”).

4. Entry: To enter during the Sweepstakes Period, Eligible Entrants will be required to visit the Pets Best Petfort at the Event and write their name and email address on their raffle ticket, before placing in the ticket in the entry box provided (“Entry”). Limit one Entry per person during the entire Sweepstakes Period.

5. Random Drawing, Odds and Winner Notification: On or about 2:00 pm MT on March 29th, 2025, Sponsor will conduct a random drawing to select four (4) winners and alternates, from among all eligible Entries received that day. Winners will be announced at approximately 2:00 pm MT at the Pets Best Petfort and will have 15 minutes to claim their prize in person as indicated or prize will be forfeited and an alternate winner selected and announced. Must be present to win. Approximate odds of winning are dependent upon the total number of eligible Entries received.

Drawing will be conducted and administered by Sponsor, whose decision is final on all matters relating to this Sweepstakes.

All potential winners are subject to verification by Sponsor. An Eligible Entrant is not a winner of any prize unless and until Eligible Entrant's eligibility has been verified and Eligible Entrant has been notified that verification is complete.

6. Prizes and Approximate Retail Values ("ARV") and Prize Fulfilment:Prizes are as follows: 4 Winners will be awarded two (2) Main Stage passes for Saturday, March 29, 2025 (“Festival”) (ARV $91.17 each). ARV of all prizes is approximately $729.36. All applicable federal, state and local taxes are the responsibility of the winners. Passes must be picked up by winners at the Treefort box office in Julia Davis Park no later than 4 p.m. MST on the day that their name is announced. Must be present to win. In the event a winner already has passes for the Festival, they may transfer their winning passes to a friend or family member who is able to attend on March 29, 2025, the day that the prize is won. Passes must then be redeemed at the Treefort Box Office in Julia Davis Park by 10 p.m. MST on the day the prize is won to attend Festival. Return of any email as undeliverable will result in disqualification and forfeiture of passes.

Prizes do not include transportation or accommodations to the Festival. No substitutions are permitted, except by Sponsor, who reserves the right, in its sole discretion, to substitute a prize of equal or greater value, if any prize becomes unavailable. No cash redemption of prizes, except at Sponsor's sole discretion.

7. General Rules: By participating in the Sweepstakes, Eligible Entrants agree to be bound by these Official Rules and the decisions of the Sponsor. Acceptance of any prize constitutes permission for the Sponsor to use each winner's name and/or likeness for internal purposes without further compensation, for a winners list, unless prohibited by law. In the event there is a discrepancy or inconsistency between disclosures or other statements contained in any Sweepstakes materials and the terms and conditions of the Official Rules, the Official Rules shall prevail, govern and control. Entries become the property of the Sponsor. The Sponsor and its agents are not responsible causes beyond the control of Sponsor that corrupt or affect the administration, security, fairness, integrity, or proper conduct of the Sweepstakes, Sponsor reserves the right, in its sole discretion, to disqualify any individual who tampers with the entry process, and to cancel, terminate, modify or suspend the Sweepstakes and randomly select the winners from all eligible Entries received prior to such cancellation. Sponsor is not responsible for typographical or other error in printing of the offer or administration of the Sweepstakes or announcement of the prizes.

8. Release:Sweepstakes Eligible Entrants release, defend, discharge, indemnify and hold harmless Sponsor and its parent, affiliates, subsidiaries, legal advisors, advertising and promotional agencies, and their respective officers, directors, employees, agents and representatives and all others associated with the development and execution of this Sweepstakes (collectively, the “Released Parties”) from any and all losses, costs, damages, injuries, claims, liabilities, and actions of any kind in connection with or participation in the Sweepstakes or resulting from acceptance, possession, or use of any prize, including, without limitation, personal injuries, death or property damage, claims based on publicity rights, defamation, or invasion of privacy and claims based on or from any typographical, human or other error in the printing, offering, selection, operation or announcement of any Sweepstakes activity and/or Prize). Eligible Entrants agree that Released Parties shall have no responsibility or liability for human error; incorrect or inaccurate transcription of Entry or for any late, lost, incomplete, illegible, stolen, undelivered, misdirected Entries, or for printing, typographical, human or other error, including, without limitation, errors by any of the equipment or programming associated with or utilized in the Sweepstakes or which may occur in the printing, the offering or announcing of prizes, administration of the Sweepstakes or the processing of Entries of any kind relating to or in connection with this Sweepstakes.

Each Eligible Entrant further agrees to indemnify and hold harmless Released Parties from and against any and all liability resulting or arising from any Sweepstakes and to release all rights to bring any claim, action or proceeding against Released Parties and hereby acknowledge that Sponsor has neither made nor are in any manner responsible or liable for any warranty, representation or guarantee, express or implied, in fact or in law, relative to a prize, including express warranties provided exclusively by a supplier of such prize that may be sent along with a prize. Sponsor is not responsible for the actions of Eligible Entrants in connection with any Sweepstakes, including Eligible Entrants' attempts to circumvent the Official Rules or otherwise interfere with the administration, security, fairness, integrity or proper conduct of the Sweepstakes.

Eligible Entrants further understand and agree that all rights under Section 1542 of the Civil Code of California (“Section 1542”) and any similar law of any state or territory of the United States that may be applicable with respect to the foregoing release are hereby expressly and forever waived. Eligible Entrants acknowledge that Section 1542 provides that: “A GENERAL RELEASE DOES NOT EXTEND TO CLAIMS THAT THE CREDITOR OR RELEASING PARTY DOES NOT KNOW OR SUSPECT TO EXIST IN HIS OR HER FAVOR AT THE TIME OF EXECUTING THE RELEASE AND THAT, IF KNOWN BY HIM OR HER, WOULD HAVE MATERIALLY AFFECTED HIS OR HER SETTLEMENT WITH THE DEBTOR OR RELEASED PARTY.” The releases hereunder are intended to apply to all claims not known or suspected to exist with the intent of waiving the effect of laws requiring the intent to release future unknown claims.

9. CAUTION: ANY ATTEMPT BY AN ENTRANT TO DELIBERATELY UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW AND TO DISQUALIFY SUCH ENTRANT FROM THE SWEEPSTAKES. IN ADDITION, SPONSOR RESERVES THE RIGHT TO PERMANENTLY DISQUALIFY ANY PERSON IT BELIEVES HAS INTENTIONALLY VIOLATED THESE OFFICIAL RULES.

Each winner acknowledges that no other party nor any agent or attorney of any other party has made any promise, representation or warranty whatsoever, express or implied, not contained herein concerning the subject matter hereof, to induce any winner to execute any document and winners acknowledge that they have not executed any document in reliance on any such promise, representation or warranty not contained herein. Any waiver by the Sponsor and its affiliates of any term of any document in a particular instance shall not be a waiver of such term for the future. Each winner agrees that the invalidity or enforceability of any part of any document shall in no way affect the validity or enforceability of any of the remainder of that document.

10. LIMITATION OF LIABILITY/GOVERNING LAW:EACH ELIGIBLE ENTRANT AGREES THAT TO THE EXTENT PERMITTED BY APPLICABLE LAW: (1) ANY AND ALL CLAIMS, JUDGMENTS AND AWARDS SHALL BE LIMITED TO ACTUAL OUT-OF-POCKET COSTS INCURRED, INCLUDING COSTS ASSOCIATED WITH ENTERING THIS SWEEPSTAKES BUT IN NO EVENT WILL ATTORNEYS' FEES BE AWARDED OR RECOVERABLE; AND (2) UNDER NO CIRCUMSTANCES WILL ELIGIBLE ENTRANT BE PERMITTED TO OBTAIN AWARDS FOR, AND ELIGIBLE ENTRANT HEREBY KNOWINGLY AND EXPRESSLY WAIVES ALL RIGHTS TO CLAIM, PUNITIVE, INCIDENTAL AND CONSEQUENTIAL DAMAGES AND ANY OTHER DAMAGES, OTHER THAN FOR ACTUAL OUT-OF-POCKET EXPENSES, AND ANY AND ALL RIGHTS TO HAVE DAMAGES MULTIPLIED OR OTHERWISE INCREASED. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE MAY NOT APPLY TO YOU. EACH ENTRANT HEREBY WAIVES THEIR RIGHT TO CONTEST JURISDICTION FOR ANY SUCH DISPUTE OR CLAIM. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the Eligible Entrant and Sponsor in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the laws of the State of New York, without giving effect to any choice of law or conflict of law rules (whether of the State of New York or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of New York.

11. DISPUTE RESOLUTION AND NO CLASS RELIEF:Any claim, cause of action or proceeding arising out of or relating to any Promotion shall be resolved by mandatory, binding arbitration in accordance with the Commercial Arbitration Rules of the American Arbitration Association (“AAA”) as supplemented by AAA's Supplementary Procedures for Consumer-Related Disputes. The Federal Arbitration Act, and not any state law concerning arbitration, shall apply. The arbitration award shall be final and exclusive, and the prevailing party in the arbitration may file an action in court to confirm and to enforce the arbitration award. Eligible Entrants irrevocably waive any rights to seek and/or obtain injunctive or other equitable relief. Should either party pursue any other judicial or administrative action with respect to any matter included within the scope of this binding arbitration provision, the responding party will be entitled to recover its costs, expenses and attorneys' fees incurred as a result of such action. Further, any and all disputes, claims and causes of action arising out of or connected with a Sweepstakes, or any Prize awarded, will be resolved individually, without resort to any form of class action. If a court determines that a public injunctive relief claim may proceed notwithstanding the “No Class Actions” provision, and that determination is not reversed on appeal, then the public injunctive relief claim will be decided by a court, and any individual claims will be arbitrated. The parties will ask the court to stay the public injunctive relief claim until the other claims have been finally concluded.

12. Winners List: To receive a Winners List by email, send an email to: press@petsbest.com with “The 2025 Petfort Music Festival Sweepstakes” as the subject line. Requests must be received by April 30, 2025.

NO PURCHASE NECESSARY. A PURCHASE OR PAYMENT OF ANY KIND WILL NOT INCREASE YOUR CHANCES OF WINNING.

1. Eligibility: The Pets Best Fur-Ever Grateful Sweepstakes (the “Sweepstakes”) is open only to legal residents of the fifty (50) United States and the District of Columbia who are at least eighteen (18) years old at the time of entry. 3. Timing: The Sweepstakes begins on January 21, 2025 at 12:00 a.m. Eastern Time ("ET") and ends on January 31, 2025 at 11:59 p.m. ET (the "Promotion Period"). Instagram's servers are the official time-keeping devices for the Sweepstakes.

4. How to Enter:
Participation Requirements: To participate via entry method (a) or (b), you will need to have a personal Instagram account. Creating an account is free but subject to the applicable terms and conditions. If entering via a mobile device and using your wireless carrier’s network, standard data charges from your wireless carrier may apply.

There are three (3) ways to enter the Sweepstakes:

(a) Comment on the Pets Best Instagram Post: During the Promotion Period, locate Sponsor’s post on Instagram that advertises this Sweepstakes (herein the “Sweepstakes Post”) and take the following actions to receive one (1) entry:

2. Like the Sweepstakes Post; and
3. Comment on the Sweepstakes Post and “at mention” a friend with whom you have a personal relationship.
4. To remain eligible, you must not change your Instagram handle once you post to enter this Sweepstakes and until the prizes are awarded (as described in Section 6).

(b) Create an Original Instagram Post: During the Promotion Period, take the following actions to receive one (1) entry:

1. Post an original photo of your pet(s) on your Instagram page and include the hashtag #PetsBestFureverGratefulSweepstakes in the original caption of your post;
2. Your account settings must be public when you post and remain public until the prizes are awarded (as described in Section 6); and
3. To remain eligible, you must not change your Instagram handle once you post to enter this Sweepstakes and until the prizes are awarded (as described in Section 6).

Your comment or post need not include any reference, positive or negative, to Sponsor’s products or services. Including a reference, image, etc. in your social post will not improve your chances of winning. Instagram stories and Instagram posts where the hashtag is included in a comment rather than the caption of the original post will not be deemed entries. Sponsor, in its sole discretion, may disqualify any post that it finds unlawful, or in violation of these Official Rules.

Content Restrictions for your Entry:

• Your comment/post must be your original work;
• Your comment/post must not convey any claims of Sponsor's products or services that would be deemed unsubstantiated or deceptive if made by Sponsor;
• Your comment/post must not disparage Sponsor or any other parties;
• You must have permission to include the names or likenesses of other individuals and to grant the rights set forth in Section 5. You should only include minors in your comment or post if they are your children/wards. If requested, entrant must be able to provide such permissions in a form acceptable to Sponsor;
• Your comment or post must not contain material that violates or infringes another's rights and therefore may not include logos, trademarks, or any other intellectual property other than those of the Sponsor;
• Your comment or post must not make references to or include: alcohol, illegal drugs, tobacco, or firearms/weapons, any activities that are or appear to be dangerous, or any
• Your comment or post may not be indecent, obscene, sexually explicit, hateful, promotes bigotry, racism, hatred, or harm against any group or individual or promotes discrimination based on race, gender, religion, nationality, disability, sexual orientation, or age; and
• Your comment or post may not be tortious, defamatory, libelous, disparage Sponsor or any other person or party, or contain material that is unlawful in any way.

(c) Enter by Mail: To enter without commenting or posting on Instagram, print your name, address, phone number, email address, date of birth, and prize package preference (dog or cat) on a piece of paper and mail it in an envelope with proper postage to “Pets Best Fur-Ever Grateful Sweepstakes,” c/o Merkle Inc., P.O. Box 5025, Department 865840, Kalamazoo, MI 49003-5025. You will receive one (1) entry into the Sweepstakes. Limit: One (1) entry per envelope. All mail-in entries must be postmarked by January 31, 2025 and received by February 7, 2025. All entries become the exclusive property of Sponsor, and none will be acknowledged or returned. Proof of sending or submission will not be deemed to be proof of receipt by Sponsor. Sponsor is not responsible for lost, late, incomplete, invalid, unintelligible, illegible, misdirected or postage-due entries, which will be disqualified.

Entry Limit: You may enter three (3) times during the Promotion Period by any combination of entry methods. Multiple entrants are not permitted to share the same Instagram account. Any attempt by any entrant to obtain more than the stated number of entries by using multiple/different Instagram accounts, identities, registrations and logins, or any other methods will void that entrant's entries, and that entrant may be disqualified. Use of any automated system to participate is prohibited and will result in disqualification. In the event of a dispute as to the identity of an entrant, Sponsor and Administrator will rely on the information associated with entrant's social account used to enter the Sweepstakes. If additional information provided by entrant to claim the prize is inconsistent with the social account used to enter, Sponsor and/or Administrator may disqualify such entrant, and such disqualification may result in the forfeiture of any prizes won. Sponsor, in its discretion, may request additional documentation from entrant to confirm entrant's identity.

5. Sponsor's Use of Submissions: Posting an entry constitutes entrant's consent to give Sponsor a royalty-free, irrevocable, perpetual, non-exclusive license to use, reproduce, modify, publish, create derivative works from, and display such submissions in whole or in part, on a worldwide basis, and to incorporate it into other works, in any form, media or technology now known or later developed, including for promotional or marketing purposes. If requested, entrant will sign any documentation that may be required for Sponsor or its designees to make use of the non-exclusive rights entrant is granting to use the entry.

6. Grand Prize Drawing: Administrator is an independent organization whose decisions as to the selection of the potential winners are final and binding in all matters related to the Sweepstakes. Administrator will randomly select the potential Sweepstakes winners from all eligible entries received during the Promotion Period, on or around February 14, 2025. If a potential winner entered on Instagram, they will be notified by @petsbest on Instagram and will be directed to a secure online claim form and asked to provide their name, email address, mailing address, and date of birth to confirm eligibility and for prize fulfillment purposes within two (2) days of the date notice or attempted notice is sent into order to claim the prize. If a potential winner entered by mail, they will be notified by Sponsor via email and must respond to the email within two (2) days of the date notice or attempted notice is sent in order to claim the prize. If a potential winner of any prize cannot be contacted or fails to provide any other requested information within the required time period (if applicable), or the prize is returned as undeliverable, the potential winner forfeits the prize. Receiving a prize is contingent upon compliance with these Official Rules. In the event that a potential winner forfeits the prize or is disqualified for any reason, Sponsor will award the applicable prize to an alternate winner by random drawing from among all remaining eligible entries. Only three (3) alternate drawings will be held, after which the prize will remain un-awarded.

7. Prize: Ten (10) GRAND PRIZES: Each winner will receive the prize package associated with the selection (dog or cat) provided to Sponsor during the winner confirmation process (if winner entered on Instagram) or entry process (if winner entered by mail). If winner fails to provide preference to Sponsor, a prize package will be randomly assigned.

Dog Prize Package: Each winner will receive a prize package that includes one (1) dog bed, one (1) grooming vacuum, and three (3) KONG dog toys. Approximate Retail Value (“ARV”): $249.44

Cat Prize Package: Each winner will receive a prize package that includes one (1) cat bed, one (1) cat tree, one (1) deshedding brush, and three (3) KONG cat toys. ARV: $248.41.

Prizes are non-transferable, and no substitution will be made except as provided herein at the Sponsor's sole discretion. Sponsor reserves the right to substitute a prize for one of equal or greater value if the designated prize should become unavailable for any reason. Winners are responsible for all taxes and fees associated with prize receipt and/or use. Odds of winning a prize depend on the number of eligible entries received during the Promotion Period. Severability:If the application of any provision of these Official Rules to any particular facts or circumstances shall for any reason be held to be invalid, illegal or unenforceable by a court, arbitration panel or other tribunal of competent jurisdiction, then (a) the validity, legality and enforceability of such provision as applied to any other particular facts or circumstances, and the other provisions of these Official Rules, shall not in any way be affected or impaired thereby; and (b) such provision shall be enforced to the maximum extent possible. In addition, if any provision contained in these Official Rules shall for any reason be held to be excessively broad as to duration, geographical scope, activity or subject, it shall be construed by limiting and reducing it, so as to be enforceable to the extent compatible with applicable law.

7. Winner Determination: One (1) winner will be determined after the Contest Period concludes. A panel of qualified judges, determined by Sponsor in its sole discretion, will select the one (1) entrant with the highest-scoring Submission based on the following criteria (“Judging Criteria”):

• Quality of Submission (34%);
• Fit to Contest Theme (33%); and
• Creativity/Originality (33%)

In the event of a tie, the entrant whose Submission received the highest score for "Quality of Submission," as determined by the qualified judges in their sole discretion, will be deemed the applicable potential winner from amongst the tied entrants. Sponsor reserves the right not to select a winner if, in its sole discretion, it does not receive any eligible and qualified Submissions. Sponsor will not disclose judging scores.

8. Winner Requirements: On or around May 14, 2024, the potential winner will be notified by @petsbest via private message on Instagram and will be directed to a secure online claim form and asked provide their full name, mailing address, email address, and date of birth to confirm eligibility and for prize fulfillment purposes within two (2) days of the date notice or attempted notice is sent to claim the prize. The potential winner (or parent/legal guardian if winner is a minor in his/her state of residence) will be required to sign and return a Declaration of Compliance, Liability Waiver and, where not prohibited, a Publicity Release ("Declaration") which must be received by Administrator, within five (5) days of the date notice or attempted notice is sent, in order to claim the prize. If the potential winner of the prize cannot be contacted, fails to sign and return the Declaration or provide any other requested information, within the required time period (if applicable), or the prize is returned as undeliverable, the potential winner forfeits the prize. 14. Disputes: Except where prohibited, each entrant agrees that: (1) any and all disputes, claims and causes of action arising out of or connected with this Contest or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the United States District Court for the Eastern District of Michigan (Southern Division) or the appropriate Michigan State Court located in Oakland County, Michigan; (2) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Contest, but in no event attorneys’ fees; and (3) under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim, indirect, punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the entrant and Sponsor in connection with the Contest, shall be governed by, and construed in accordance with, the laws of the State of Michigan without giving effect to any choice of law or conflict of law rules (whether of the State of Michigan or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of Michigan.

Severability:If the application of any provision of these Official Rules to any particular facts or circumstances shall for any reason be held to be invalid, illegal or unenforceable by a court, arbitration panel or other tribunal of competent jurisdiction, then (a) the validity, legality and enforceability of such provision as applied to any other particular facts or circumstances, and the other provisions of these Official Rules, shall not in any way be affected or impaired thereby; and (b) such provision shall be enforced to the maximum extent possible. In addition, if any provision contained in these Official Rules shall for any reason be held to be excessively broad as to duration, geographical scope, activity, or subject, it shall be construed by limiting and reducing it, so as to be enforceable to the extent compatible with applicable law.

1. Eligibility: The 2024 Petfort Music Festival Sweepstakes (the “Sweepstakes”) is open to legal residents of the United States (including DC and other Territories), aged 18 or older as of the date of entry (“Eligible Entrants”). The Sweepstakes is subject to all applicable federal, state, and local laws and regulations. 2. Sweepstakes Period: Sweepstakes begins at 11:00 a.m. Mountain Time (“MT”) through 1:45 p.m. MT daily on 3/23/24 and 3/24/24 (the “Sweepstakes Period”) at the Tree Music Festival in Downtown Boise, ID (“Event”).

3. Sponsor: Pets Best Insurance Services, LLC, 965 Keller Rd. Altamonte Springs, FL 32714 (“Sponsor”).

4. Entry: To enter during the Sweepstakes Period, Eligible Entrants will be required to visit the Pets Best Petfort at the Event and write their name and email address on their raffle ticket, before placing in the ticket in the entry box provided (“Entry”). Limit one Entry per person during the entire Sweepstakes Period.

5. Random Drawing, Odds and Winner Notification: On or about 2:00 pm MT on March 23^rd and 24^th, 2024, Sponsor will conduct a random drawing to select three (3) winners and alternates, from among all eligible Entries received each day. Entries made on the first day will not carry over to the second day. Winners will be announced at approximately 2:15 pm MT at the Pets Best Petfort and will have 15 minutes to claim their prize in person as indicated or prize will be forfeited and an alternate winner selected and announced. Must be present to win. Approximate odds of winning are dependent upon the total number of eligible Entries received.

Drawing will be conducted and administered by Sponsor, whose decision is final on all matters relating to this Sweepstakes.

All potential winners are subject to verification by Sponsor. An Eligible Entrant is not a winner of any prize unless and until Eligible Entrant's eligibility has been verified and Eligible Entrant has been notified that verification is complete.

6. Prizes and Approximate Retail Values ("ARV") and Prize Fulfilment: Prizes are as follows: 6 Winners (3 per day) will be awarded two (2) Main Stage Festival passes for the day that the prize is won, either Saturday, March 23, 2024 or Sunday, March 24, 2024 (“Festival”) (ARV $120 each). ARV of all prizes is approximately $720. All applicable federal, state and local taxes are the responsibility of the winners. Passes must be picked up by winners at the Treefort box office in Julia Davis Park no later than 4 p.m. MST on the day that their name is announced. Must be present to win.  In the event a winner already has passes for the Festival, they may transfer their winning passes to a friend or family member who is able to attend on March 23, 2024 or March 24, 2024, the day that the prize is won. Passes must then be redeemed at the Treefort Box Office in Julia Davis Park by 10 p.m. MST on the day the prize is won to attend Festival. Return of any email as undeliverable will result in disqualification and forfeiture of passes.

Prizes do not include transportation or accommodations to the Festival. No substitutions are permitted, except by Sponsor, who reserves the right, in its sole discretion, to substitute a prize of equal or greater value, if any prize becomes unavailable. No cash redemption of prizes, except at Sponsor’s sole discretion.

7. General Rules: By participating in the Sweepstakes, Eligible Entrants agree to be bound by these Official Rules and the decisions of the Sponsor. Acceptance of any prize constitutes permission for the Sponsor to use each winner's name and/or likeness for internal purposes without further compensation, for a winners list, unless prohibited by law. In the event there is a discrepancy or inconsistency between disclosures or other statements contained in any Sweepstakes materials and the terms and conditions of the Official Rules, the Official Rules shall prevail, govern and control. Entries become the property of the Sponsor. 8. Release: Sweepstakes Eligible Entrants release, defend, discharge, indemnify and hold harmless Sponsor and its parent, affiliates, subsidiaries, legal advisors, advertising and promotional agencies, and their respective officers, directors, employees, agents and representatives and all others associated with the development and execution of this Sweepstakes (collectively, the “Released Parties”) from any and all losses, costs, damages, injuries, claims, liabilities, and actions of any kind in connection with or participation in the Sweepstakes or resulting from acceptance, possession, or use of any prize, including, without limitation, personal injuries, death or property damage, claims based on publicity rights, defamation, or invasion of privacy and claims based on or from any typographical, human or other error in the printing, offering, selection, operation or announcement of any Sweepstakes activity and/or Prize). Eligible Entrants agree that Released Parties shall have no responsibility or liability for human error; incorrect or inaccurate transcription of Entry or for any late, lost, incomplete, illegible, stolen, undelivered, misdirected Entries, or for printing, typographical, human or other error, including, without limitation, errors by any of the equipment or programming associated with or utilized in the Sweepstakes or which may occur in the printing, the offering or announcing of prizes, administration of the Sweepstakes or the processing of Entries of any kind relating to or in connection with this Sweepstakes.

Each Eligible Entrant further agrees to indemnify and hold harmless Released Parties from and against any and all liability resulting or arising from any Sweepstakes and to release all rights to bring any claim, action or proceeding against Released Parties and hereby acknowledge that Sponsor has neither made nor are in any manner responsible or liable for any warranty, representation or guarantee, express or implied, in fact or in law, relative to a prize, including express warranties provided exclusively by a supplier of such prize that may be sent along with a prize. Sponsor is not responsible for the actions of Eligible Entrants in connection with any Sweepstakes, including Eligible Entrants’ attempts to circumvent the Official Rules or otherwise interfere with the administration, security, fairness, integrity or proper conduct of the Sweepstakes.

Eligible Entrants further understand and agree that all rights under Section 1542 of the Civil Code of California (“Section 1542”) and any similar law of any state or territory of the United States that may be applicable with respect to the foregoing release are hereby expressly and forever waived. Eligible Entrants acknowledge that Section 1542 provides that: “A GENERAL RELEASE DOES NOT EXTEND TO CLAIMS THAT THE CREDITOR OR RELEASING PARTY DOES NOT KNOW OR SUSPECT TO EXIST IN HIS OR HER FAVOR AT THE TIME OF EXECUTING THE RELEASE AND THAT, IF KNOWN BY HIM OR HER, WOULD HAVE MATERIALLY AFFECTED HIS OR HER SETTLEMENT WITH THE DEBTOR OR RELEASED PARTY.” The releases hereunder are intended to apply to all claims not known or suspected to exist with the intent of waiving the effect of laws requiring the intent to release future unknown claims.

9. CAUTION: ANY ATTEMPT BY AN ENTRANT TO DELIBERATELY UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW AND TO DISQUALIFY SUCH ENTRANT FROM THE SWEEPSTAKES. IN ADDITION, SPONSOR RESERVES THE RIGHT TO PERMANENTLY DISQUALIFY ANY PERSON IT BELIEVES HAS INTENTIONALLY VIOLATED THESE OFFICIAL RULES.

Each winner acknowledges that no other party nor any agent or attorney of any other party has made any promise, representation or warranty whatsoever, express or implied, not contained herein concerning the subject matter hereof, to induce any winner to execute any document and winners acknowledge that they have not executed any document in reliance on any such promise, representation or warranty not contained herein. Any waiver by the Sponsor and its affiliates of any term of any document in a particular instance shall not be a waiver of such term for the future. Each winner agrees that the invalidity or enforceability of any part of any document shall in no way affect the validity or enforceability of any of the remainder of that document.

10. LIMITATION OF LIABILITY/GOVERNING LAW: EACH ELIGIBLE ENTRANT AGREES THAT TO THE EXTENT PERMITTED BY APPLICABLE LAW: (1) ANY AND ALL CLAIMS, JUDGMENTS AND AWARDS SHALL BE LIMITED TO ACTUAL OUT-OF-POCKET COSTS INCURRED, INCLUDING COSTS ASSOCIATED WITH ENTERING THIS SWEEPSTAKES BUT IN NO EVENT WILL ATTORNEYS’ FEES BE AWARDED OR RECOVERABLE; AND (2) UNDER NO CIRCUMSTANCES WILL ELIGIBLE ENTRANT BE PERMITTED TO OBTAIN AWARDS FOR, AND ELIGIBLE ENTRANT HEREBY KNOWINGLY AND EXPRESSLY WAIVES ALL RIGHTS TO CLAIM, PUNITIVE, INCIDENTAL AND CONSEQUENTIAL DAMAGES AND ANY OTHER DAMAGES, OTHER THAN FOR ACTUAL OUT-OF-POCKET EXPENSES, AND ANY AND ALL RIGHTS TO HAVE DAMAGES MULTIPLIED OR OTHERWISE INCREASED. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE MAY NOT APPLY TO YOU. EACH ENTRANT HEREBY WAIVES THEIR RIGHT TO CONTEST JURISDICTION FOR ANY SUCH DISPUTE OR CLAIM. 11. DISPUTE RESOLUTION AND NO CLASS RELIEF: Any claim, cause of action or proceeding arising out of or relating to any Promotion shall be resolved by mandatory, binding arbitration in accordance with the Commercial Arbitration Rules of the American Arbitration Association (“AAA”) as supplemented by AAA’s Supplementary Procedures for Consumer-Related Disputes. The Federal Arbitration Act, and not any state law concerning arbitration, shall apply. The arbitration award shall be final and exclusive, and the prevailing party in the arbitration may file an action in court to confirm and to enforce the arbitration award. Eligible Entrants irrevocably waive any rights to seek and/or obtain injunctive or other equitable relief. Should either party pursue any other judicial or administrative action with respect to any matter included within the scope of this binding arbitration provision, the responding party will be entitled to recover its costs, expenses and attorneys’ fees incurred as a result of such action. Further, any and all disputes, claims and causes of action arising out of or connected with a Sweepstakes, or any Prize awarded, will be resolved individually, without resort to any form of class action. If a court determines that a public injunctive relief claim may proceed notwithstanding the “No Class Actions” provision, and that determination is not reversed on appeal, then the public injunctive relief claim will be decided by a court, and any individual claims will be arbitrated. (b) Create an Original Instagram Post: During the Promotion Period, take the following actions to receive one (1) additional entry:

1. Post an original photo of your pet(s) on your Instagram page and include the hashtag #ThankfulPetParentSweepstakes in the original caption of your post;
2. Your account settings must be public when you post and remain public until the prizes are awarded (as described in Section 6); and
3. To remain eligible, you must not change your Instagram handle once you post to enter this Sweepstakes and until the prizes are awarded (as described in Section 6).

Your comment or post need not include any reference, positive or negative, to Sponsor’s products or services. Including a reference, image, etc. in your social post will not improve your chances of winning. Instagram stories and Instagram posts where the hashtag is included in a comment rather than the caption of the original post will not be deemed entries.

• Your comment/post must be your original work;

Entry Limit: You may enter one (1) time per entry method (2 times total) during the Promotion Period. Multiple entrants are not permitted to share the same Instagram account. Any attempt by any entrant to obtain more than the stated number of entries by using multiple/different Instagram accounts, identities, registrations and logins, or any other methods will void that entrant's entries and that entrant may be disqualified. Use of any automated system to participate is prohibited and will result in disqualification. In the event of a dispute as to any registration, the authorized account holder of the Instagram account used to register will be deemed to be the entrant. The “authorized account holder” is the natural person assigned an email address by an Internet access provider, online service provider or other organization responsible for assigning email addresses used to create the Instagram account. Each potential winner may be required to show proof of being an authorized account holder. 5. Sponsor’s Use of Social Content: Posting an entry constitutes entrant’s consent to give Sponsor a royalty-free, irrevocable, perpetual, non-exclusive license to use, reproduce, modify, publish, create derivative works from, and display such submissions in whole or in part, on a worldwide basis, and to incorporate it into other works, in any form, media or technology now known or later developed, including for promotional or marketing purposes. If requested, entrant will sign any documentation that may be required for Sponsor or its designees to make use of the non-exclusive rights entrant is granting to use the entry.

6. Grand Prize Drawing: Administrator is an independent organization whose decisions as to the administration and operation of the Sweepstakes and the selection of the potential winners are final and binding in all matters related to the Sweepstakes. Administrator will randomly select the potential Sweepstakes winners from all eligible entries received during the Promotion Period, on or around November 27, 2023. Each potential winner will be notified by @petsbest on Instagram and will be directed to a secure online claim form and asked to provide his/her name, email address, mailing address, and date of birth to confirm eligibility and for prize fulfillment purposes within two (2) days of the date notice or attempted notice is sent into order to claim the prize. If a potential winner of any prize cannot be contacted or fails to provide any other requested information within the required time period (if applicable), or the prize is returned as undeliverable, the potential winner forfeits the prize. Receiving a prize is contingent upon compliance with these Official Rules. In the event that a potential winner forfeits the prize or is disqualified for any reason, Sponsor will award the applicable prize to an alternate winner by random drawing from among all remaining eligible entries. Only three (3) alternate drawings will be held, after which the prize will remain un-awarded.

7. Prizes: TEN (10) GRAND PRIZES: Each winner will receive the prize package associated with the breed (dog or cat) provided to Sponsor during winner confirmation process. If winner fails to provide preference to Sponsor, a prize package will be randomly assigned.

CAT PRIZE PACKAGE: Each winner will receive a prize package that includes one (1) cat backpack, one (1) $100 PetSmart® gift card (terms and conditions apply), and two (2) KONG toys. ARV: $200.00.

Prizes are non-transferable, and no substitution will be made except as provided herein at the Sponsor’s sole discretion. Sponsor reserves the right to substitute a prize for one of equal or greater value if the designated prize should become unavailable for any reason. Release: By entering this Sweepstakes, entrants agree to release and hold harmless Sponsor, Administrator, Instagram, Inc., and their respective subsidiaries, affiliates, suppliers, distributors, advertising/promotion agencies, and prize suppliers, and each of their respective parent companies and each such company’s officers, directors, employees and agents (collectively, the “Released Parties”) from and against any claim or cause of action, including, but not limited to, personal injury, death, or damage to or loss of property, third party claims involving the right to privacy, right of publicity, or intellectual property infringement, arising out of participation in the Sweepstakes or receipt or use or misuse of any prize.

Publicity: Except where prohibited, participation in the Sweepstakes constitutes each winner’s consent to Sponsor’s and its agents’ use of winner’s name, prize information, likeness, Submission, photograph (including, without limitation, winner's Instagram profile photo), voice, opinions and/or hometown and state for promotional purposes in any media, worldwide, without further payment or consideration.

10. General Conditions: Sponsor reserves the right to cancel, suspend and/or modify the Sweepstakes, if any fraud, technical failures, human error, or any other factor impairs the integrity or proper functioning of the Sweepstakes, or any event or cause beyond Sponsor’s control (e.g. events such as natural calamities, national emergencies, wide spread illnesses, declarations of war, acts of God, acts of terrorism) interferes with any aspect of the Sweepstakes, including but not limited to fulfillment of the prize(s), as determined by Sponsor in its sole discretion. Publicity: Except where prohibited, participation in the Sweepstakes constitutes each winner’s consent to Sponsor’s and its agents’ use of winner’s name, prize information, likeness, Submission, photograph (including, without limitation, winner's Instagram profile photo), voice, opinions and/or hometown and state for promotional purposes in any media, worldwide, without further payment or consideration.

10. General Conditions: Sponsor reserves the right to cancel, suspend and/or modify the Sweepstakes, if any fraud, technical failures, human error, or any other factor impairs the integrity or proper functioning of the Sweepstakes, or any event or cause beyond Sponsor’s control (e.g. events such as natural calamities, national emergencies, wide spread illnesses, declarations of war, acts of God, acts of terrorism) interferes with any aspect of the Sweepstakes, including but not limited to fulfillment of the prize(s), as determined by Sponsor in its sole discretion. In such event, Sponsor, in its sole discretion, may elect to hold a random drawing from among all eligible entries received up to the date of discontinuance and may modify the prizes offered herein. Sponsor reserves the right, in its sole discretion, to disqualify any individual it finds to be tampering with the entry process or the operation of the Sweepstakes or to be acting in violation of the Official Rules of this or any other promotion or in an unsportsmanlike or disruptive manner. Any attempt by any person to deliberately undermine the legitimate operation of the Sweepstakes may be a violation of criminal and civil law, and should such an attempt be made, Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law. Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.

11. Limitations of Liability: The Released Parties are not responsible for: (1) any incorrect or inaccurate information, whether caused by entrants, printing errors or by any of the equipment or programming associated with or utilized in the Sweepstakes; (2) technical failures of any kind, including, but not limited to malfunctions, interruptions, or disconnections in phone lines or network hardware or software; (3) unauthorized human intervention in any part of the entry process or the Sweepstakes; (4) technical or human error which may occur in the administration of the Sweepstakes or the processing of entries; (5) late, lost, undeliverable, damaged or stolen mail; or (6) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant’s participation in the Sweepstakes or receipt or use or misuse of any prize. If for any reason an entrant's entry is confirmed to have been erroneously deleted, lost, not received, or otherwise destroyed or corrupted, entrant’s sole remedy is another entry in the Sweepstakes if it is possible. No more than the stated number of prizes will be awarded. In the event that production, technical, seeding, programming or any other reasons cause more than the stated number of prizes as set forth in these Official Rules to be available and/or claimed, Sponsor reserves the right to award only the stated number of prizes by a random drawing among all legitimate, un-awarded, eligible prize claims.

12. Disputes: Except where prohibited, entrant agrees that: (1) any and all disputes, claims and causes of action arising out of or connected with this Sweepstakes or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the United States District Court for the Eastern District of Michigan or the appropriate Michigan State Court located in Oakland County, Michigan; (2) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Sweepstakes, but in no event attorneys’ fees; and (3) under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim, indirect, punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the entrant and Sponsor in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the laws of the State of Michigan without giving effect to any choice of law or conflict of law rules (whether of the State of Michigan or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of Michigan.
