Petsbest Sponsorship Contest Rules
July 27 – September 7, 2009
1. NO PURCHASE OR PAYMENT OF ANYKIND IS NECESSARY TO ENTER OR WIN THE CONTEST.
A PURCHASE WILL NOT INCREASEYOUR ODDS OF WINNING. VOID WHERE PROHIBITED OR RESTRICTED BY LAW.
2. General Conditions. The Contest is sponsored by Pets Best Insurance Services, LLC (Pets Best Insurance.) The Contest is governed by the laws of the State of Idaho and applicable United States federal law, without regard to any conflict of law principles. The courts ofthe State of Idaho (state and federal) shall have exclusive jurisdiction over any dispute regarding the Contest, and by entering the Contest you waive any objection to jurisdiction and venue in those courts and submit to the jurisdiction of those courts. If you enter the Contest, you agree to abide by the terms of these Official Contest Rules and by the decisions of Pets Best Insurance, which shall be made in all cases in the sole and absolute discretion of Pets Best Insurance and are final and binding on all matters relating to the Contest.
3. Eligibility. The Contest is open only to persons who are at least eighteen (18) years of age as of the date of entry and who are legal residents of the United States.The Contest is void outside the United States. Employees, officers, directors or managers of Pets Best Insurance its affiliates, advertising or promotion agencies, or participating sponsors or promotional partners, or the immediate family (defined as current spouse, parents, children, siblings and their respective spouses) of such individuals and persons living in the same household are prohibited from winning the Contest.
4. Entry. The Contest will officially begin at 8 AM PDT on Monday, July 27, 2009 and all entries must be received by 12pm PDT on Monday, September 7, 2009 (the"Contest Period"). This Contest Period may be extended by Pets BestInsurance at any time and for any reason. Entrants may enter the Contest by completing all of the required information and following all instructions. Submit your entry by clicking on the "Enter the Contest" button. Only one (1) entry per person is permitted.
Pets Best Insurance will not be responsible for incomplete, lost, late, misdirected or illegible entries or for failure to receive entries due totransmission failures or technical failures of any kind, including, without limitation, malfunctioning of any network, hardware or software, whether originating with sender or Pets Best Insurance. In the event of a dispute, all online entrieswill be deemed to have been submitted by the owner of the email account fromwhich they were sent. For these purposes, an email account holder shall meanthe natural person assigned to such email account by the Internet access provider, online service provider or other organization responsible for assigning email addresses for the domain associated with such email account. Any questions regarding the number of entries submitted or the owner of an email account shall be determined by Pets Best Insurance in its sole discretion, and Pets Best Insurance reserves the right to disqualify any entries by persons determined to be tampering with or abusing any aspect of the Contest.
5. Prizes and Odds. Contest winners will be selected from among all eligible entries pursuant to a judging by Pets Best Insurance personnel following the end of the Contest Period. The Contest winner will receive one of the listed prizes as determined by Pets Best Insurance. Odds of winning depend on the number of eligible entries received.
6. Winner Notification andAcceptance. The winner of the Contest will be notified by email at the end of Contest Period. Return of prize notification as undeliverable or no response within three (3) days may result in disqualification and an alternate winner may be selected. The winner of the Contest may waive their right to receive the prize. The prize is non-assignable and non-transferable. The winner of the Contest is solely responsible for reporting and payment of any taxes on the prize. The winner of the Contest maybe required to complete an affidavit of eligibility, and a liability and publicity release (except where prohibited by law) which must be returned within ten (10) days from the date of its receipt. Failure to sign and return the affidavit or release within ten (10) days of its receipt, or to comply with any term or condition of these Official Contest Rules, may result in the winner’s disqualification, the forfeiture of his or her interest in the prize, and the award of the prize to an alternate winner. Except where prohibited by law, participation in the Contest constitutes entrant’s consent to the publication of his or her name, biographical information and likeness in any media for any commercial or promotional purpose, without limitation or further compensation. 7. Participation. By participating, entrants agree to be bound by these Official Contest Rules and the decisions of Pets Best Insurance. In the event the Contest is compromised by a virus, non-authorized human intervention, tampering or other causes beyond the reasonable control of Pets Best Insurance which corrupts or impairs the administration, security, fairness or proper operation of the Contest, Pets Best Insurance reserves the right in its sole discretion to suspend, modify or terminate the Contest. Should the Contest be terminated prior to the stated expiration date, Pets Best Insurance reserves the right to award the prize based on the entries received before the termination date.
8. Limitations of Liability. In addition to the other terms and conditions contained in these Official Contest Rules, by entering the Contest, entrant agrees that (a)any and all disputes, claims, and causes of action arising out of or in connection with the Contest, or the prize awarded, shall be resolved individually without resort to any form of class action, and entrant waives his or her right to a jury trial for such disputes, claims, and causes of action;(b) any claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, but in no event attorneys’ fees; and (c) under no circumstances will any entrant be permitted to obtain any award for, and entrant hereby waives all rights to claim punitive, incidental or consequential damages and any and all rights to have damages multiplied or otherwise increased and anyother damages, other than damages for actual out-of-pocket expenses, excluding attorneys’ fees.
9. Severability. The invalidity or unenforceability of any provision ofthese Official Contest Rules shall not affect the validity or enforceability of any other provision of these Official Contest Rules. If any provision of the Official Contest Rules is determined to be invalid or otherwise unenforceable, then the Official Contest Rules shall be construed in accordance with their terms as if the invalid or unenforceable provision was not contained therein.
10. General Release. By entering the Contest, entrant releases Pets Best Insurance, and any other promotional sponsors, and each of their respective affiliated companies, directors, officers, managers, employees, representatives, partners and agents from any liability whatsoever for any claims, costs, injuries, losses or damages of any kind arising out of or inconnection with the Contest or with the acceptance, possession or use of the prize (including, without limitation, claims, costs, injuries, losses ordamages related to personal injuries, death, damage to, loss or destruction of property, rights of publicity or privacy, defamation or portrayal in a false light).
11.Sponsor. This Contest is sponsored by Pets Best Insurance, whose decisions regarding the selection of the winner of the Contest and all other aspects of the Contest shall be final and binding in all respects. Pets Best Insurance will not be responsible for typographical, printing or other inadvertent errors in these Official Contest Rules or in other materials relating to the Contest.
